Information in connection with processing of personal data in
the course of a business relationship with customers, suppliers
and other business contacts.

On the following pages, we wish to provide you with an overview about processing of your personal data and your rights under the EU General Data Protection Regulations (EU GDPR) in force.

The nature of the business relationships provides largely the framework, which data are processed in detail and in which way are used.  Therefore, not all parts of this information will apply to you.

2. What data and on what legal basis do we process and for what purpose?

In the context of the business relationships with our business partners (customers, suppliers, service providers, etc.) we process personal data that you provide us with.  If our business relationship exists with your employer resp. client, we also collect personal data from you or your employer resp. client.

These are the following data or categories of data:

  • General Data (e. g. name, salutation, title, functional title)
  • Contact Details (e.g. phone number, fax number, email address, company’s address)
  • Communication Data (e.g. content of personal communication, communication by phone or in written form)
  • Billing Information (e. g. banking details)
  • Quotation Data 
  • Factory Access Data (Date, time, occasion, contact with KEF)  

Data processing is led primarily to fulfill contractual obligations  (EU GDPR  Art. 6 (1 li b), more precisely for the purpose of unambiguous identification of the business partner and for initiation, implementation, administration and management of contracts, the assessment of financial standing and securitization, the creation of settlements/credits, the administration and enforcement of claims, compliance with legal regulations, data security and in the interest of comprehensive customer service.

Insofar as necessary, we also process personal data to meet legal requirements (EU GDPR Art. 6 (1 lit c).

These are:

  • Observance of statutory storage obligations
  • Observance of statutory notification requirements

Moreover, we will process personal data to safeguard legitimate interests (EU GDPR Art. 6 (1 lit f).

  • Maintaining of business relationship
  • Establishing of legal claims
     

3. Who has access to your data?

Within the framework of the initiation and implementation of business relationship and the execution of the respective business processes, your data will be processed within Fischer TireTech Germany GmbH by the respective employees involved.

Furthermore, we transmit your data to recipients outside the company, who process your data on their own responsibility (EU GDPR Art. 4 (7).

These can be, for example, the following categories of responsible persons:

  • Third parties e.g Credit institution and financial institutions
  • Public bodies on the basis of legal regulations (e.g. tax authorities)

In addition, certain personal data may also be transferred to a third country (EU GDPR Art. 44).  Focus is on Art. 5 (1 lit b EU GDPR). Personal data will only be transmitted for explicitly defined purposes. In detail, this concerns personal customer data that must be exchanged in the context of business relationships

(EU GDPR - Art. 6 (1 lit b).

4. How long will your data be stored?

We store the personal data for the duration of the business relationship. After termination of the business relationship, the data will be stored for as long as we are obliged to do so. This is due to the storage and proof obligations. The storage period may be up ten years. 
Furthermore, it may be necessary to retain personal data until the expiry of the statutory limitation period - up to 30 years - while claims can be made against us.

5. What data protection rights do the persons concerned have?

The business partners of Fischer TireTech Germany GmbH have a right to information (EU GDPR Art. 15), rectification (EU GDPR Art. 16), deletion (EU GDPR Art. 17), limitation in processing  (EU GDPR Art. 18), Data portability  (EU GDPR Art. 20)  and raising objections  (EU GDPR Art. 21), if appropriate, revocation of an earlier permission (EU GDPR Art. 7).

It also gives you the possibility, as business partner, to make a complaint to the Authority for Data Protection (EU GDPR Art. 77).

  1.  By providing or sending personal data in the form of a CV, cover letter, filling in a questionnaire on www.konstrukta.sk the applicant for employment or the person concerned provides, pursuant to Act no. 122/2013 Coll. on the Protection of Personal Data and on the Amendment to Certain Acts (the "Personal Data Protection Act") as amended, the employer KONŠTRUKTA -TireTech, s.r.o. personal information included in your resume, cover letter, questionnaire, emails to find a suitable job. KONŠTRUKTA -TireTech, s.r.o shall not provide the data of the applicant for employment to the third parties.KONŠTRUKTA -TireTech, s.r.o shall proceed with the processing of personal data of the applicant for employment, the person concerned in accordance with the provisions of the Personal Data Protection Act. Other entities will be given access to the personal data of the applicant, the person concerned only in the cases provided for by the applicable legislation (in particular in the course of administrative or criminal proceedings). Jobseeker, the person concerned notes that he/she is obliged to state his / her personal data correctly and truthfully.
  2. KONŠTRUKTA -TireTech, s.r.o will treat and archive the personal data of the applicant for employment, the person concerned for a maximum of 2 years in accordance with special regulations. Personal data will be processed electronically in an automated way or printed form in a non-automated manner. KONŠTRUKTA -TireTech, s.r.o has the right to correct inaccurate, incomplete or outdated personal data, liquidation or blocking of the personal data and the other ones mentioned in the Section 28 Subsection  1 of the Personal Data Protection Act.
  3. An applicant for employment, the person concerned confirms that the personal data provided by him / her are true and he / she is responsible for the untruthfulness of the personal data. Jobseeker, the person concerned declares that she/he is aware of the consequences of false information, in particular the fact that such a procedure could be classified as a criminal offense.
  4. The applicant for employment, the person concerned has the right to demand from KONŠTRUKTA -TireTech, s.r.o:
    • Correction of the personal data that concern him / her
    • Deletion of the personal data concerning him / her
    • At any time, withdraw your consent
    • Restrict the processing of the personal data that concern him / her
    • Confirmation of what personal data is processed and for what purposes
